Central Coast Council's Development Control Plan 2022, Chapter 2.12 Waterfront Structures, covers Brisbane Water, the canals of St Huberts Island and the Tuggerah Lakes estuary. The limits differ by waterway. On Brisbane Water, a pontoon may replace the widened head of a jetty, but it must fit the same limits as the jetty. Domestic jetties on the Tuggerah Lakes estuary may not exceed a basic length of 30 m, against 50 m on Brisbane Water. In the St Huberts Island canals, a pontoon can be no larger than 3 m x 4 m and must be fibreglass or similar construction.
Council's Tuggerah Lakes estuary page describes the lakes as perched and very shallow, averaging 1.7 m deep. Minor flooding starts at 0.9 m AHD (Australian Height Datum), and the July 2022 flood peaked at 1.72 m AHD. For structures on the lakes, the DCP requires any material dug out from below low tide or the water table to be tested for potential acid sulfate soils, and treated before disposal if they are found.
A 2015 NSW DPI report notes that the Posidonia australis seagrass population in Brisbane Water is listed as endangered under the NSW Fisheries Management Act. None of the marine parks on NSW DPI's list, as archived in April 2024, involves Central Coast Council, but harming marine vegetation without a fisheries permit is an offence anywhere in NSW waters. The DCP also notes that waterfront structures may be Integrated Development needing DPI Fisheries approval. When you enquire, say which waterway the boat or pontoon is on.
